Nadine Heredia is in Brazil after requesting diplomatic asylum
Minister Dias Toffoli, of the Federal Supreme Court (STF), ordered this Tuesday (10) the annulment of evidence from Operation Lava Jato against the former first lady of Peru Nadine Heredia Alarcón (photo).
Toffoli responded to Nadine’s lawyers’ request for the nullity of evidence obtained through investigations involving the Drousys and My Web Day systems, maintained by the former construction company Odebrecht, to organize the payment of bribes to public agents.
Since April this year, Nadine has been in Brazil after requesting diplomatic asylum from the Brazilian government. She is the wife of former President of Peru Ollanta Humala.
In Peruvian justice, Nadine Heredia and Ollanta Humala were sentenced to 15 years in prison for money laundering, on charges of having received illicit amounts for political campaigns in 2011, in a case involving the Brazilian construction company, which also operated in Peru.
In the decision, the minister extended to Nadine the understanding that also annulled several Lava Jato procedures that used Odebrecht systems, the evidence of which was considered illegal by the Supreme Court.
With the minister’s statement, the sharing of evidence from the systems with Peruvian authorities is prohibited.
“I further determine that a copy of this decision be forwarded to the Ministry of Justice, notifying the aforementioned unreliability, as regards the applicant, of the aforementioned elements of evidence, highlighting, from now on, the prohibition of the practice, in national territory, of any investigative or cooperative acts based on these elements so that they can be forwarded to the government of Peru”, decided the minister.
