This Thursday the decree of the government that sets the objective criteria for the foster care of migrant minors by the communities came into force. The PP response, a party that manages most autonomies, goes through blocking the distribution that marks the law. And that the three regions that demand territorial solidarity have the presence of the right in their executives: Canary Islands and the autonomous cities of Ceuta and Melilla. In addition, Balears is also very close to meet the requirements.

The first three have not expected to request the migratory contingency declaration, a figure introduced by the new law. Once the Ministry of Youth and Childhood recognizes it, the derivations of unaccompanied minors will begin to the Peninsula.

To activate immigration contingency, communities must prove that they welcome triple minors of which their own means can attend. Canary Islands, for example, has 737 places, but welcomes 5,017 minors. Free the criteria and its president, Fernando Clavijo, warned on Wednesday that “there are no excuses” to initiate the process and warned that he is “convinced” that the Prosecutor’s Office will intervene “ex officio” to guarantee compliance.

The Canary Islands government is coalition. The vice president is Manuel Domínguez, leader of the PP in the archipelago since 2023, although he barely makes statements about what his own Tacha party of “emergency”. This summer has barely appeared on a couple of occasions to claim the Government to execute the sentence of the Supreme Court that forces the minors attended in the Canary Islands. Domínguez has accused the Executive of breaching the law, but has ignored that the communities that govern their party partners block said cast.

Clavijo’s is the same warning that the Minister of Territorial Policy, Ángel Víctor Torres on Thursday. “It does not fit us that the presidents are not going to comply with the law,” he said in an interview in RNE. “We are sure that they will do it,” he added, to warn: “But if a community does not respond, that moves to the Prosecutor’s Office and the relevant mechanisms are activated with the State Security Forces and Bodies.”

The PP reaction to both statements has been very different, and that is almost traced. “Threatening the communities if they do not comply with an unfair decree-law is typical of any regime less than a democracy,” said his secretary general, Miguel Tellado, in statements to the sixth.

As they have been doing in recent years, the leaders of the right have demanded that the central government run with the expenses derived from foster care, although it is an autonomous competence. This Thursday, the Vice -Secretary Carmen Fúnez regretted that the Executive activated the reception “without knowing if they have the appropriate resources” and without “putting on the table an economic memory that guarantees them.”

“Spaces are needed where they live with dignity,” he added, to remember that the communities have the obligation of the “guardian and guardianship” of the kids to the age of majority, which implies “food, training and security.” Fúnez did not say a word about the expense of the autonomous communities in this matter.

Alberto Núñez Feijóo’s ‘number two’ also criticized Torres to regret that the communities had no problem in hosting thousands of Ukrainian children fleeing from Russia’s attacks, while refusing to receive a few hundred African minors. Tellado called “racist” to the minister and launched a usual bulus in the mouth of the spokesmen of the PP: that Italy and Greece have put a preserve to the “illegal immigration” with different policies to the Spanish.

Reality is very different. According to the official data of the European Union and the UN on August 24, 2025, 22,699 people arrived irregularly. Of these, 11,916 did it for the Canary Islands. In the same period, Italy have arrived almost twice as many migrants in an irregular situation: 40,510. All of them, by sea. To Greece, 27,662 people, more than 24,000 per sea.

Ceuta and Melilla also, governed directly by the PP, have asked to activate the new legal mechanism. According to the Law, in the Ministry of Childhood directed by Sira Rego, it has five days to recognize the situation and implement the mandatory transfer of minors from the regions affected to other communities.

The Royal Decree-Law sets the number of places that each community must have, at least, to serve migrant minors. Andalusia, with 2,827 squares, is in the lead. It is followed by Catalunya (2,650), Madrid (2,325), Community Valenciana (1,767), Galicia (886), Castilla y León (783), Canary Islands (737), Basque Country (731),

Castilla-La Mancha (692), Murcia (517), Aragon (441), Balearic Islands (406), Extremadura (344), Asturias (331), Navarra (223), Cantabria (194) and La Rioja (107).

But it is not clear that the government can begin the transfer because the 10 autonomous communities governed by the PP have appealed the decree before the Constitutional Court for “invading exclusive powers in minors protection and social assistance, lack of urgency justification and using an inappropriate instrument to regulate matters reserved for organic laws”. The PP recognizes that the competent communities to serve migrant minors are the communities. To them has joined the Castilla-La Mancha of the socialist Emiliano García Page.

Madrid has also brought the decree before the Supreme Court. According to their spokesman, Catalunya and Euskadi are out of the cast. A false statement: the formula used by the norm to calculate the effort that each community must make, which takes into account the ordinary capacity, the number of minors that already welcomes, the rent, the unemployment rate, the previous effort, the dispersion or situation of the border city or insularity, leaves them out of the obligation at the moment.

Even so, Catalonia will voluntarily receive 31 minors in this first derivation of 3,000 minors. The Basque President, Imanol Pradales, also came up with the criticism of the PP and revealed that he had spoken by telephone with his Andalusian counterpart, Juan Manuel Moreno, who pointed out the alleged lack of solidarity of the Basques.

Pradales claimed “less noise and more collaboration” about migrants and said that “half arrives by Bus from Andalusia.” He also explained, said Pradales, that he was “absolutely confused when he said publicly that the Euskadi Border effect had been recognized” because “it has not been recognized.”

Balears, on both sides

If the PP lives a dichotomous situation, Balearic Islands is about to be a community with one foot on each side. The Government of Marga Prohens rejects the distribution of migrants and is one more of those that has taken it to the Constitutional. But the arrival of people from Algeria has multiplied this summer, and threatens to bring their capabilities to the limit, according to their own calculations.

This was stated by the Government this week, despite recognizing that they are not at the limit. “We don’t care if the figures come to us or do not reach us,” said the Minister of Presidency, coordination of the local government and cooperation action, Antònia Maria Serellas. “We have a slightly different situation to other autonomous communities, because we have an arrival route. The figures are not comparable to those of the Canary Islands, but if we continue, they will be,” he settled.

The central government responded on Thursday that, for the moment, they are not in a position to claim the immigration contingency situation. Prohens replied that the Government that she directs does not find “spaces or professionals” to accommodate and serve minors.

Thus, the president of the Balearic Islands is willing to claim the migratory contingency that she has appealed before the Constitutional Court for invasion of powers that, as she has declared, cannot comply.

No criticism of Abascal

Amid the debate between government and PP, the Vox leader, Santiago Abascal. In a tweet (it has not made statements in person for weeks), the leader Ultra accused the ship of the Open Arms of “Negrero” and asked to “sink” and “confiscate” the ship, arrived in recent days to the Canary Islands.

Abascal’s words were replicated by the government. The second vice president, Yolanda Díaz, lamented the “little humanity” of Abascal, while the Minister of the Presidency, Félix Bolaños, condemned the “verbal violence” of the Vox leader and the hate speeches “which” end up justifying physical violence. ”

Also Clavijo, who shares government with the PP, crossed out of “authentic fascist” to Abascal. “This is a nonsense, it generates tension, discomfort and makes a skinny favor to democracy, unless Abascal also bothers democracy, which we already doubt,” he settled.
