The General Council of the Judiciary will investigate the complaints of the Attorney General of his personal data in the cause of the Supreme Court in which he is charged. The Department of Data Protection has opened actions after receiving both the complaints of Álvaro García Ortiz and those of Dolores Delgado about the reports of the Central Operating Unit, put by Judge Hurtado available to the parties in full, include their Telephone numbers but also, in the case of the first, its postal address in Galicia.
The actions will be carried out by the Directorate of Supervision and Control of Data Protection of the Government Body of the Judges will carry out the actions.
Both the Attorney General and his predecessor were addressed yesterday to the Judiciary and the Criminal Chamber of the Supreme Court to denounce that one of the last reports of the Civil Guard contributed to the process had exposed their personal data, to the point of understanding that had compromised his personal safety. The report, commissioned by the Judge to the UCO, reflects the traffic of calls from the Attorney General and includes an annex where his postal address and telephones of several people from the Prosecutor’s Office are offered with which he spoke in those days of March 2024.
“They put my security at risk,” said the attorney general when heading to the CGPJ to request urgent measures. Dolores Delgado, with which he had conversations those days that are referenced in the report, also denounced that his phone was published and that he had received calls from unknown numbers since then.
This is not the first complaint of the State Attorney General about the management that the Civil Guard and Judge Ángel Hurtado make of their personal data once they are embodied in their reports made available to the parties. From the data of their mobile phones, calls and contacts to its postal address and the numbers and addresses of some of its collaborators. To date, the instructor has dismissed all his complaints.
In the Public Ministry several voices have showed their dissatisfaction with the management that the instructor makes of the personal data of the Attorney General and his environment reflected in the reports of the Central Operating Unit, and how his latest reports detail his communications with prosecutors not Related to the case, such as Dolores Delgado, a prosecutor and vowel of the Council and others of its collaborators, but do not reflect communications, for example, with the prosecutor Chief Anti -Corruption that also appears in the calls of calls obtained by the agents, or With a director of the newspaper La Razón.
The Attorney General’s calls
Judge Ángel Hurtado investigates since last October if the attorney general or his closest team leaked last March an email in which Alberto González Amador’s lawyer, a couple of Isabel Díaz Ayuso, confessed the fiscal fraud of 350,000 euros and offered a pact to avoid jail. A cause in which he has tried to investigate the communications that García Ortiz maintained those days, both by telephone and by WhatsApp and also by email.
The agents of the Central Operational Unit, as recognized by the Attorney General himself, have certified that he changed mobile phone a week after the case was opened in the Supreme Court. Before that October 2024 there are no records of messages or relevant emails. A last report by the Civil Guard certifies that he deleted all his messages on October 16, 2024: the day the cause was opened.
“In none of the cases it is possible to recover information on dates before October 16, 2024,” says a police report contributed to the cause. The first available message is that day at three in the afternoon. That day, explains the Civil Guard Cybercrime Unit, García Ortiz caused “a permanent erase of existing messages in all conversations.”
As for the calls, the Civil Guard has also certified that in those days of March the attorney general barely spoke with people not related to the Prosecutor’s Office. The agents only highlighted a brief conversation with a manager of La Razón on March 8 and, already on the night of March 13 that constitutes the center of the case, how a journalist from the SER chain called him but could not contact him.
