The judge of the Supreme Criminal Court Leopoldo Puente has decreed this Wednesday the provisional release of the former Secretary of Organization of the PSOE Santos Cerdán considering “seriously mitigated” the risk of destruction of evidence that justified his imprisonment on June 30. The former ‘number three’ of the PSOE will not be able to travel abroad and will have to appear in court every 15 days.
The Supreme Court magistrate affirms that “there are” sources of evidence that have “reinforced” the evidence against the former socialist leader and that have allowed new lines of investigation to be opened. A recent report from the Civil Guard contributed to the summary places him in meetings with Acciona “as a Transport liaison” for the alleged rigging of works and locates new perks for him and his family. He is being investigated for crimes of criminal organization, bribery and influence peddling.
The judge points out that the risk that the person under investigation could hide, alter or destroy relevant sources of evidence, which was very intense when he agreed to go to prison, is already “seriously mitigated” as a consequence of the investigation carried out. The instructor states that, thanks to these investigations, it has been possible to obtain information that, most likely, would have been “occluded or very difficult to access.” Cerdán has spent almost five months in prison.
In his order, the judge details the investigation carried out, not only has it not diluted the “consistent” evidence that was already available in the case, but “it has largely reinforced them and opened new lines of investigation.” But he adds that the existence of these indications “does not in itself justify the maintenance of provisional detention, even when, as is the case in this case, the progress of the investigation has only confirmed and strengthened said indications.”
