Four acts of genocide
In its 72 pages report, the existence of four of the five genocide criteria: “murders, cause serious bodily damage, deliberately inflict living conditions calculated to cause the destruction and imposition of measures aimed at preventing births.”
These crimes are characteristics of the genocide and were committed by Israeli authorities and security forces “with the specific intention of destroying, totally or partially, the Palestinians in Gaza.”
These conclusions are added to others issued this year or in 2024, such as those of the UN Rapporteur, which in March 2024 already issued a report denouncing the existence of an ongoing genocide, or those of the Lemkin Institute for the prevention of genocide. In addition, this summer the highest academic authority on the subject, the International Association of Genocide Scholars, also pronounced in a similar way, just as organizations such as Amnesty International, Human Rights Watch or B’Tselm. The responsibility of the states
The UN Independent Investigation Commission states that all states have an immediate legal duty, by virtue of the Genocide Convention, to use all the means available to “prevent and punish” the crime of genocide. That is, they must adopt “all measures”. “Failure to comply with legal and moral consequences,” he warns.
The report recalls that “the duty to prevent a genocide is universal and immediate” and stresses that “the credibility of the international community depends on an urgent action.”
Given this, it lists a series of mandatory measures by the states, which it asks “to use all the means” available to prevent the genocide commission in Gaza and “cease the transfer of armament, equipment, including fuel for airplanes, to Israel or third states where there is suspicion of its use in military operations that have involved or can involve genocide”.
In addition, it asks countries to ensure that people and corporations under their jurisdiction do not participate in genocide, or support or promote it, and investigate and process those who may be involved in it. It also asks that they facilitate internal investigations and processes, and that they adopt measures – including sanctions – against the State of Israel and against individuals or corporations “involved in the genocide commission or in its facilitation”.

The aforementioned crimes are “findings about the specific intention to destroy, in all or part, the Palestinian group in Gaza” intentionally. The researchers emphasize that, in July 2025, 46% of the Palestinian fatalities were women and children, and that 83% were civilians. The commission emphasizes that the Israeli authorities knew that the Palestinians were trapped in Gaza and could not flee, and “they continued to ensure that they could not escape violence and eventual destruction.”
For the rest, he emphasizes that Israel has implemented “a concerted policy to destroy the Gaza health system, attacking facilities and medical units, killing, hurting, arresting, arresting, mistreating and torturing health personnel since October 2023”. At the same time, “he blocked medical equipment, supplies and medicines, and prevented the exit of Palestinians in need of attention.”

In their presentation, the researchers highlight the importance of these conclusions, “solid and authorized” and remember that the genocide “is happening now”, “is developing in real time.” Therefore, “the legal, moral and political duty of the states is clear.”
“The world must now act to stop the killings, protect the Palestinian people and fulfill their obligations to prevent and punish the crime of genocide,” the UN Independent Research Commission ends.
In March 2024, the United Nations Rapporteur for Palestine, Francesca Albanese, already developed a detailed investigation, with a legal basis, in which he presented the existence of indications of genocide, under the title “Anatomy of a genocide.” Since then, the more than 50 UN rapporteurs, the highest academic authority on genocide -international Association of Genocide Scholars-, experts at the individual level and organizations such as Amnesty International, B WSELEM or Human Rights Watch have concluded in their investigations that Israel carries out a genocide in Gaza.
In addition, in three provisional orders issued more than a year ago – the first of them, in January 2024 – the International Court of Justice already indicated that it was “plausible” that Israel was committing a genocide in Gaza. There was no reaction to warnings and genocide continued, until today.
