In a document presented to the Judiciary by Alejandrina Barry and Agustín Comas, both from the Center of Professionals for Human Rights, they report the important support received by Lustramax workers from human rights representatives and organizations and from other representatives from the political, cultural, social and union spheres.
The text states: “As members of the Center of Professionals for Human Rights (CeProDH), we introduce ourselves at IPP: 01-15-1643-26 and say: That given the situation that the Lustramax SRL workers are experiencing, the labor conflict caused by the illegal conduct of the company and the news that is publicly known about the intervention of the criminal justice system in a labor dispute and an order for the return of property, with criminal law being the ultima ratio, different Human Rights organizations and Personalities in that field, as well as in the political field, have expressed their concern to me and have signed a petition in which they express their solidarity with the workers and consider that the criminal complaints are used for the purpose of intimidating workers.”.
The writing indicates that the solidarity on the part of referents and figures was immediate: “In less than 24 hours and among other important personalities, which shows the deep concern that exists around this case, Adolfo Pérez Esquivel (Nobel Peace Prize Winner and President of the Provincial Commission for Memory); Elia Espen (Mothers of Plaza de Mayo Founding Line); Carlos “Sueco” Lorkipanidse (ESMA survivor); Osvaldo Barros (Association of Former Detained and Disappeared); Patricia Walsh (former deputy) have provided their support. national); the Human Rights Secretariat of CTA-A Capital; Hermanos de Desaparecidos por la Verdad y la Justicia; Luis Zamora (Legal Action Committee); PTS-Frente de Izquierda); Alejandro Vilca (provincial deputy of Frente de Izquierda, Jujuy), Matías Aufieri (Center of Professionals for Human Rights), Christian Castillo (deputy of the Province of Buenos Aires, PTS-Frente de Izquierda). This among more than 200 personalities and figures from the political, social, union and human rights spheres.”.
The text of the petition is the following:
We, the undersigned, stand in solidarity with the Lustramax workers and denounce the illegal dismissals by the employers and their written refusal to comply with the mandatory conciliation, asking instead for an eviction request from the criminal justice system. On Monday, January 12, the Lustramax company denied 13 workers entry to the plant, sending the Police of the Province of Buenos Aires and the DDI to intimidate the workers who were meeting in the Assembly.
Within the framework of the forceful strike and the impact in the media, he notified with a notary paid by the same company the dismissal of the two plant representatives. On Tuesday, January 13, the Ministry of Labor issued a Mandatory Conciliation that rolls back the layoffs and implies that all workers return to their usual tasks. However, the employer stated in writing in the file that it will not comply with the mandatory conciliation without justification. And initiates a criminal case with a request for eviction. We consider that this attack is inadmissible and violates the most basic rights of workers and we call for the broadest solidarity and to surround this struggle with support.”
