A Court of Leganés has opened a second judicial case against former high positions of the Government of Isabel Díaz Ayuso directly involved in the management of residences during the first wave of the pandemic in the Community of Madrid, as communicated tide of residences and confirmed Eldiario.es of judicial sources.

Last Monday, May 26, two former high positions and an Ayuso advisor were summoned to declare as charged in Court 3 of Madrid. The statement was suspended since the investigated alleged that they had not been transferred from the proceedings and could not defend themselves. After five years, it was the first time they were going to declare as charged with high positions of the Ayuso government. The procedure was provisionally filed, but was reopened on April 1 at the request of the Provincial Prosecutor’s Office.

Always according to the tide of residences, the procedure that is followed in Court 6 of Leganés does not part of a complaint by the Prosecutor’s Office, but of a complaint filed by two relatives of residents. Both causes share the reason for the complaint: the commission of a crime of discriminatory denial of health care, punished in article 511 of the Criminal Code.

Within the framework of this procedure, the declaration of several witnesses next Tuesday, June 3, starting at 10 am. Among them, Alberto Reyero, a Minister of Social Policies when Pandemia arrived and who from the first moment denounced the discrimination that the elderly who lived in residences were suffering.

The same day will testify four other people: Juan Abarca Cidón, president of HM Hospitals, one of the main private health groups in the Community of Madrid; Antonio Burgueño, appointed in the second week of March 2020 as a “main advisor” of Ayuso for the fight against pandemia, and the two complainants.

The families of the deceased are also aware of the statements of Carlos Mur, director of socio -sanitary coordination during the Covid crisis, and their substitute in office, Francisco Javier Martínez Peromingo. The two former positions that had their first appearance scheduled on May 26.

Reyero explained in an interview in National Radio This Monday that cost him “to think that a decision of that draft”, in allusion to the protocols that prevented the nursing home, “was taken by a general director on his own,” exempting Mur from being the final responsible for that health strategy.

The investigation of what happened in the residences during the pandemia is a demand that the relatives of deceased in the elderly have been claiming five years. Once they have managed to get exalted positions from the government of Isabel Díaz Ayuso to have to give explanations about the protocols that prevented health care, the Madrid president has chosen to link this judicial decision with Pedro Sánchez.

“This was filed three years ago, now the provincial Prosecutor’s Office reopens, which hierarchically depends on the Lord who has undertaken a state operation against me, and that in turn this man depends on the president of the Government,” the president replied on Wednesday when asked about the imputation of three people who were part of his team during the pandemic.
