The judge of the National Court Ismael Moreno, who is investigating the Koldo case, supports his request to the PSOE for the party in Government to hand over each and every one of the expenses that it has paid for seven years to “officials, workers, sympathizers or volunteers, along with the supporting documents on which said payments are supported.”

The magistrate responds in an order to the request for clarification made by the PSOE to the order issued by Moreno on November 26 in which he asked this political party to, within a period of ten days, provide the court with a list of cash payments made and documents supporting them, during the period from 2017 to 2024.

The party understood in its letter that it was a “generic” request and that it should only send the data relating to José Luis Ábalos and Santos Cerdán, investigated in the case, and not all of its employees during those years, with the danger that private information of militants or sympathizers ends up in the hands of popular accusations. “There is also no right to demand that the PSOE hand over all this enormously sensitive information so that it ends up in the archives of the Popular Party, VOX and Hazte Oir, no less,” the letter said.

The head of the Central Court of Instruction 2 assumes point by point the thesis of the Anti-Corruption Prosecutor’s Office, which in its report stated that the resolution of the judicial body is “sufficiently clear, without containing any obscure concept, and it is not possible to extend it, as the applicant intends, for such a requirement to be extended only to the people investigated in Special Case 20775/2020 pursued before the Supreme Court as intended in this procedure.” And this, Alejandro Luzón’s subordinate added, because said information (not in terms of documentary support) was already provided and it would make no sense to request it again if it already appears in the proceedings.

In his order, the judge considers that the information refers to transcendental issues for the clarification of the facts, so the diligence is considered pertinent and necessary, “taking into account that the information provided by the police unit acting in the police report of 10/08/2025 and that the testimonial evidence carried out in the Supreme Court did not sufficiently explain the origin of the cash amounts that the PSOE would have at its headquarters to cover with it the compensation of expenses of those investigated and other possible beneficiaries; that this form of payment was not uncommon.”

The investigation is based on a mismatch between the statements contained in the messages seized from Koldo García, with photographs of envelopes with money and the PSOE logo, and the expenses recorded in his accounting. This imbalance was just a few hundred euros and the party explained, and documented, that it was due to the fact that its recipient was not only José Luis Ábalos but also his Organization team, hence the difference between what was put on the envelopes and what is recorded was paid to the former number three of the party.

The statements of the former manager and an employee did not convince the chief anti-corruption prosecutor, Alejandro Luzón, or the judge of the Supreme Court, Leopoldo Puente, who referred the facts to the National Court, because the case was investigated there from its origin, before there were cases. The initial thesis was that Ábalos was able to launder money from corruption by passing expenses to the PSOE.

Now, Judge Moreno says in his order that “it is about investigating and adequately verifying the execution of alleged conduct that, both at the level of the criminal response and at the level of social significance, can be extremely serious and require investigation in order to determine the manner and reason for the cash payments made.”

In this way, the judge is requesting from the PSOE an avalanche of documentation between 2017 and 2024 without the party being investigated as a legal entity in the case and without any of the people affected by this documentation also having the status of defendants, beyond José Luis Ábalos, Koldo García and Santos Cerdán.

The PSOE has reacted to the judge’s order by assuring that it “respects the decision and will attend to the request presented with complete normality.” “It is part of the procedure and, as always, we will collaborate with Justice,” authoritative party sources assure. In this sense, they remember that the PSOE accounts “are supervised and audited” and add: “All the information required will be provided. Transparency is not only announced, it is practiced.”
