This recent video from one of the most important legal firms in Argentina shows how the lawyers of the main companies and multinationals are beginning to be bothered by the jurisprudence that we have been winning in different courts against discrimination against workers and against the Bases Law. These are judicial sentences achieved with much struggle under this anti-worker and repressive government.

Directly, the lawyer says that they want to carry out discriminatory dismissals and that the justice system cannot order the annulment of that act and the consequent reinstatement to the job.

In reality, they never forgave us for the “Balaguer v. Pepsico” ruling that we obtained with the Center of Professionals for Human Rights (CeProDH) 20 years ago, where it was recognized that reinstatement corresponds to discriminatory dismissal. That Balaguer ruling was later reinforced by the ruling of the Supreme Court of Justice of the Nation in “Álvarez v. Cencosud” and many others. We managed to establish jurisprudence that does not allow companies to carry out discriminatory dismissals based on union activity or ideology, politics or any other type of discrimination (religious, sex, nationality, etc.).

A lot of time passed, but with the Bases Law they found a way to introduce art. 245 bis in the Employment Contract Law and order that, in the event of discriminatory dismissal, only aggravated compensation is applicable and in no way a return to the job. That rule came about by force of traitors and buying votes with the suitcases of corruption.

Now they return to the issue because, despite this unconstitutional law, and as a result of the workers’ struggle, we have managed to reverse it in several sentences against large multinationals such as Shell or companies like Georgalos.

The large legal firms that profit by destroying labor rights and the multinationals defend the bosses’ dictatorship in the factory.

We are going to be with the workers defending their rights, in the streets, in debates in Congress or in Courts. Wherever, always on the same side.
