The judicial resolution is a new coup to the government, in particular to the Minister of Security Patricia Bullrich, who ordered the operation and that in repeated opportunities, he said that the actions of Cape Guerrero complied with the established protocol. However, the police map, shortly after being seriously injured the photojournalist Pablo Grillo, published a sequence of photos where it is demonstrated that the gendarme pointed directly to the body, and that when Paul received the shot, the gendarmes celebrated.
In this context, the ruling of federal judge María Servini, who prosecuted after the National Gendarmerie, Héctor Jesús Guerrero, for “abuse of aggravated weapons”, is a new blow to the government.
The first Cape of the Argentine National Gendarmerie, Héctor Jesús Guerrero, is responsible for shooting with his gases gases against photographer Pablo Grillo during the demonstration against Congress on March 12. The judge established that Guerrero fired on six opportunities, violating all protocols. One of those 38 mm caliber cartridges, designed to disperse crowds with gas, impacted fully into the head of Grillo, who was 47 meters away, crouched and doing his work.
Eventual intent: acceptable damage
The failure is overwhelming by characterizing the intention of the gendarme. Judge Servini considered that she acted with “eventual intent”, a legal figure that implies that the accused was mentally represented the possibility of causing serious damage and, even so, he accepted that risk indifferently.
“The processed here represented the possibility of producing very serious injuries, and with their psychic attitude or predisposition, the eventuality of the result was indifferent,” says the resolution.
Guerrero is not a rookie
Far from being an effective rookie, Guerrero has ten years of service in the gendarmerie, he was part of an immediate employment section and served as a shooting instructor. I knew perfectly the manual of the weapon he used, which he expressly warns: “The weapon should never be directed towards a person, since in case of impact it could cause serious injuries and even death. The shots must be executed in oblique manner, towards the ground, to cushion the force.”
Despite this, and in the midst of a protest of retirees, Guerrero decided to shoot.
Serious consequences
The projectile crossed a flame barricade and hit Grillo, causing a “complex bruising wound in a medium region face, exposed fracture of the left frontophemporpoparietal, right subdural hematoma and left epidural hematoma”. These injuries kept it months in intensive therapy, required multiple surgeries and left him neurological and physical sequelae of extreme gravity. The judge remarked that, almost seven months after the fact, her state of health is still critical and “no panorama of improvement is noted.”
Faced with the seriousness of the facts, the precautionary measure is mild: an embargo of $ 203,000,000, the obligation to present itself periodically and the prohibition of leaving the country. The judge rejected the preventive detention for the repressor.
Guerrero’s identification was possible thanks to the analysis of images provided by human rights and media organizations, where it is distinguished by the chaqui color of his uniform and a legend in the helmet that says “picha”.
This case exposes the violent actions of the security forces in social protest contexts and the application of protocols that, in practice, are ignored with impunity, having devastating consequences for workers and the people.
