Resolution 2109/2025 published this morning in the Official Bulletin by the National Government and with Mario Lugones’s pen in the National Health Portfolio, is without exaggerating an unprecedented attack on the residences system of our country, which far from being ideal, had an important conquered rights floor, product very deep in the last decades. In this note, we try to explain some of the main changes and setbacks that affect nation -dependent residences, and that we cannot miss.

In Argentina different regimes of the training system in service work and coexists, that is, of residences. Those that depend directly on the provincial entity, for example in the province of Buenos Aires residences in more than 100 hospitals and dependencies with about 5,000 residents currently according to data from the provincial ministry itself, there are also those that depend on CABA (which also has its own regime and regulations) and those that depend directly on the Ministry of Health of the Nation, such as those that work in the Posadas hospital (about 500 residents) It is currently on the struggle (more than 200 residents), Somer Hospital, Hospital de Clínicas de Córdoba, also in Anmat, Malbrán Hospital, among others.

The counter -reform announced today applies only for national residences, although without a doubt an attack on the public health system by the National Government and its Health Minister Mario Lugones, known entrepreneur of private health, one of the owners of the Sanatorio Güemes, and who carried out the decentralization and deregulation of the health system in the 90s. That is, a faithful employee of the private health lobby Corporations Now also blackmail to residents because it forces them to choose between rights and salary. More cynical is not achieved. Let’s go to the data.

Some general definitions

The decree starts from the repeal of the regulation until yesterday in force, created in 2015, with modifications in 2021 and in 2023. As we said, far from being ideal, it started from a very high floor of rights, conquered with the struggle of the residents themselves.

Now, the employment relationship of the residents with the employer entity is eliminated, now they will not be more workers but “beneficiaries of a scholarship.” This scholarship can take different forms according to the resident “choose” to have more or less rights (as if you could choose).

Government’s speech is to “rank the purpose of the medical residence that is the training of professionals and offer residents the” freedom “to choose the residence modality.” It allows residents to “choose” between an “institution scholarship” without retirement contributions or a “ministry scholarship” with social contributions and charges. Smooth and plainly blackmail.

But there is more, let’s see

-An annual renewal base: Although it leaves in Annex II and IV that the scholarships will have automatic extension “except” some circumstances, in the new regulation they explicitly leave the annual nature of them by opening the door not to renew it if they do not want.

-The time. Before it was “up to” 9 hours a day at the time determined by the establishment and 2 weekly guards of up to 12h, with a minimum period between 48 hs guards. Now the criminals of 24h, 2 per week, 8 per month, without establishing rest between guards. 9h of work have to be fulfilled, but there may be discounts.

-Deconso postguardia: In the previous regulation of 2015, it was explicitly established that after the guard the post guard of at least 6h should be guaranteed immediately after finishing his guard. Now the figure of “postguarding rest” is directly eliminated and only limited to saying that “formative half -time” must be fulfilled.

-Rol of the Ministry of Health of the Nation: The new regulation gives much more regulatory power to the Ministry and taking out the jurisdictions and the Directorate of Human Talent. That is, it removes autonomy to jurisdictions and hospitals in the formative aspect and gives much more power to the Ministry of the Staff of Lugones.

  • Holidays (ordinary licenses) before ordinary licenses were determined according to jurisdiction and direct superiors (hospitals, addresses, internal agreements, etc.) and now it is established that it is 3 weeks, not exceeding 2 consecutive weeks.
  • Resident Chiefs (Art 35 and 36):

    • They cease to be chosen by their peers (classmates who have shared their training and trajectory for years), instructors (head of residences teachers) and teaching coordinator. In the new regulation, they become chosen only by the “teaching staff”, although it leaves some autonomy to the institution for this act. All setback.

  • Permanence and evaluation (art 29):

    • The permanence according to academic or other objectives is proposed, without stating that it would be that (organize for their rights for example?). For the promotion, they raise 80% assistance (presentism) that was previously in 75%. In evaluations, they take out the recovery and promotion extension.


    With assemblies, unemployment and struggle plan in unit, you can stop!

    The Government transformed in decree what it thinks and propagandizes with its spokesmen: that residents are not workers, that health is an “expense” and not a right, that we are disposable material and if we like what they pay we look for other work.

    The fight to defend the right to form workers in the public health system is in unity.

    There is no other, this government, the only language that you understand is that of the class struggle. Every time the workers, students, retired, have taken to the streets, have had to go back in some of their measures. The fight of Htal Garrahan ceased to reveal it, threatened with hundreds of layoffs on June 30 and could not go through the force and organization that the hospital is having.

    Now, joining the fights is the task. We cannot fight separately, the whole health team must understand that it is an unprecedented attack in the public health system, today they are nation residents, but they will come for everything. In the province of Buenos Aires we come from weeks of struggle and organization for residents, fellows and ATS that fight against labor precariousness. In CABA the assembly of residents and concurrent comes to vote different struggle measures.

    It has never been clearer: it’s them or us. They, Los Milei and Caputo, the privatizing Lugones, who defend the IMF regime, those responsible for the attack on Pablo Grillo, the entrepreneurs with their employer dictatorships and dismissals. Or we, we make the world move every day, workers, retirees, students, the community that is attended to public health and defends it with us.

    We propose assemblies in each workplace and study to vote a unified struggle plan. It does not reach with positions in social networks. This Thursday is a first response and health unions also have to be there. We must mobilize in Unit to Plaza de Mayo at 4:00 p.m. and defend public and quality health.
