
The Badajoz Prosecutor’s Office has presented an appeal against the processing of the government’s president, David Sánchez. The brief, aimed at the Provincial Court, asks for the archive of the cause that has been followed for a year against the musician for his hiring in the Diputación de Badajoz.
The appeal, advanced by the Being, considers that there are only “conjectures and hypotheses” and not “authentic rational indications of crime” to process Sánchez and another ten people, among which is the president of the Pacense Diputación, Miguel Ángel Gallardo, who is also the general secretary of the PSOE of Extremadura.
In fact, the Public Ministry says in its brief that these cases, which were considered enough to initiate the procedure, “do not count-even with the provisionality of this procedural phase-with the necessary factual support to conclude that the position of coordinator of the activities of the conservatories was created ad hominem, that is, to the letter, with the objective of benefiting David Sánchez Pérez-Castejón”.
In this sense, he rules out that the creation of that place “obeyed spurious motivations”, which was a “legitimate decision” of the Pacense Diputación “justified from the perspective of the public interest” in addition, that there were witnesses who declared that “it resulted from every reasonable point.”
The appeal emphasizes that the judge does not fit in a “faithful” or “complete” way in her order of processing to the result of the proceedings that have been practiced or “individualize” clearly what indications have led him to the conclusion that the square “was designed in a spurious way and, much less, the concrete reasons that allow attributing the realization of a crime of administrative prevarication.” In the prosecution of the Prosecutor’s Office, this is contradicted with “objective facts or data that have been perfectly accredited throughout the exhaustive instruction practiced”, which have extended for a year in Court 3 of Badajoz.

The Public Ministry even recalls that Pedro Sánchez resigned from the General Secretariat of the PSOE on October 1, 2016 and Miguel Ángel Gallardo positioned himself with Susana Díaz when the socialist primaries were convened, so “it is not enough to understand” that the president of the Diputación could be willing to commit crimes “in favor of Pedro Sánchez or his surroundings.
The Prosecutor’s Office also stops in the “such manido dispatch” and recalls the location changes that Sánchez has had to perform his functions: a space in the Conservatory Library, an office, the office of the Head of Studies, another in the Diputación and the last in the central services.
Regarding the hiring of the Exassor of Moncloa and friend of David Sánchez, Luis Carrero, also prosecuted, the Prosecutor’s Office argues that the friendship or closeness is not sufficient to say that Sanchez intervened in a illegal way in favor of Carrero to occupy the position of head of centers and cross -border programs of the Diputación.
