The Court ruled that Israel will have until July 2025 to respond to allegations that it is committing genocide against Palestinians in Gaza.


South Africa presented, this Monday (28), a detailed submission to the International Court of Justice (ICJ) describing evidence of the supposed Israel’s violation of the 1948 Genocide Convention in their ongoing war in Gaza.

According to the South African presidencysubmission, also called memorialincludes 750 pages of evidence of acts of genocide and genocidal intent.

“The evidence will show that behind Israel’s genocidal acts is a special intention to commit genocide, a failure by Israel to prevent incitement to genocide, to prevent genocide itself, and its failure to punish those who incite and commit acts of genocide,” said a statement from the presidency.

He added that The evidence is presented in more than 750 pages of text, plus more than 4,000 pages of annexes.

“The South Africa Memorial is a reminder to the global community to remember the people of Palestine, to stand in solidarity with them and stop the catastrophe. The devastation and suffering were only possible because, despite the actions and interventions of the ICJ and several UN bodies, Israel failed to comply with its international obligations,” these.

The submission cannot be made public, according to court rules, the presidency said.

Israel will have until July 28, 2025 to present a response, known as a counter-memorial.

South Africa took its case to ICJ in December 2023accusing Israel of raping Genocide Conventionof which Israel is a party, during the attack on Gaza since October 7th.

The requirement for 84 pageswhich included reports from the MEEalleged that Israel committed acts with the intention of destroying the Palestinians, who are defined as a group national, racial and ethnic, in whole or in part. It also alleged that Israel failed to prevent or punish such acts.

The evidence included statements from Israeli officials expressing “genocidal intent” and a list of how Israel’s alleged actions met the definition of genocide as listed in the treaty.

Acts include: murders; cause serious physical and mental harm; mass expulsion and displacement; and deprivation of access to adequate food, water, shelter, clothing, hygiene and medical care.

On January 26, the CIJ said it was plausible that Israel had violated the Genocide Convention. As an emergency measure, he ordered Israel ensured that its army refrained from genocidal acts against Palestinians.

You can take several years until the ICJ makes a full judgment about the case. Their deliberations often involve a prolonged process of written submissions and oral arguments for all parties to the case.

Israel rejects accusations

Meanwhile, the UN Special Rapporteur on the right to food, Michael Fakhrisaid in his last report to General Assembly that to Israel’s famine policy in Gaza reaches the limit of genocidal acts and intentions.

A South African presidencyin his statement on Monday, said that Israel was allowed to violate international laws and norms with “unprecedented impunity”.

“Israel has received unprecedented impunity for violating international laws and norms since the UN Charter existed. Israel’s continued destruction of international laws has put at risk the institutions of global governance that were established to hold all states accountable.”

Several states requested intervention in the case of South Africaincluding Bolivia, Maldives, Chile, Türkiye, Spain, Mexico, Libya, Colombia e Nicaragua.

Em May 29a South Africa presented a dossier to the UN Security Councilincluding 120 pages of evidence of genocidal intent and incitement to commit genocide against Palestinians in Gaza.
